REGULAR MEETING OF THE EATON PLANNING

ZONING AND BUILDING BOARD ON OCTOBER 12, 2004

AT 7:30 P.M., IN COUNCIL CHAMBERS

 

The Eaton Planning, Zoning and Building Board met in regular session in Council Chambers on Tuesday, October 12, 2004, at 7:30 p.m.

 

The roll was called and the following was found to be:

 

            Present:            Ron Coleman

                                    Chris Atkins

                                    Steve Deffner

                                    Gary Wagner

                                    Tom Jordan

            Absent:             Harold Geeting

                                    Tim Lane

 

Also in attendance were City Manager Dave Daily, City Engineer Doug Spitler, Law Director Donnette Fisher and Engineer Tec. Joe Ferriell.  The meeting was called to order at 7:30 p.m.

 

MINUTES:

  The minutes of the August 10, 2004 and September 14, 2004 meetings were presented to the Board for approval.  Steve Deffner made a motion to accept the minutes as written and Gary Wagner seconded the motion.  The motion passed as follows:

            Ayes:  Coleman, Atkins, Deffner, Wagner, Jordan (5)

            Nays:   None

 

SWEARING IN:

 

All members of the audience anticipating to testify before the Board were asked to stand and be sworn in.  The Secretary administered the oath or affirmation to the audience.

 

AB-04-14 – Conditional Use – John V. Dye – 111 S. Barron Street:

 

Jordan:  The applicant has applied for a conditional use permit to put an apartment above the office/retail use at the building located at 111 S. Barron Street., zoned C-4.  This building was the former MRDD office, with office space on both floors since 1970.  Prior to 1970, the second floor had been an apartment.

 

John Dye, owner of the building, approached the Board with his request to have a residential apartment above the retail space below.  He explained that for the last few years it had been used as office space and the occupants had moved to a larger space.  He did try to rent it as office space, but at this time, there is not a need for such a large office area in the downtown.  This is his reason for the request to transform it back into residential/apartment use.  It does have a separate entrance on the south side of the building as well as an entrance to the back of the building.  There is also parking in the back.

 

 Doug Spitler gave staff review.  This proposed conditional use is a permitted use in the ‘C-4’ district and the Board should follow the General Conditions for approval in Chapter 1163.03 (a), items 1 through 3, and the specific requirements of Chapter 1163.03 (b) (10). This use will be for a single apartment with a separate direct access to a ground floor entrance and is in the “Downtown” Planning Area with no specific recommendations for second floor dwelling units.

 

Mr. Dye added that the ceiling and walls of the building are all up to standards and also fire rated.

 

After little discussion, Gary Wagner made a motion for favorable recommendation for AB-04-14, stating that it does meet the General Conditions of Chapter 1163.03 (a) 1 through 3 and the specific requirements of the Chapter (b) (10).  The motion was seconded by Ron Coleman and passed as follows:

            Ayes:  Coleman, Atkins, Deffner, Wagner, Jordan (5)

            Nays:   None

Ron Coleman made a motion to adjourn the meeting and Gary Wagner seconded it.  All ayes.
