MINUTES OF REGULAR MEETING OF THE COUNCIL

OF THE CITY OF EATON, OHIO HELD IN COUNCIL CHAMBERS

OF THE MUNICIPAL BUILDING AT 7:00 P.M., ON MONDAY, NOVEMBER 17, 2003



Mayor Robert Stonecash called the regular meeting of the Council of the City of Eaton, Ohio, to order at 7:00 p.m., on Monday, October 17, 2003. Reverend Jerry Reynolds delivered the invocation and led the pledge to the flag. The Deputy Clerk called the roll and found the following to be:

Present: Mr. Lawrence Petry

Absent: None

City Manager Dave Daily was also in attendance.



MINUTES

Councilman Renner moved to approve the regular meeting minutes of October 20, 2003. Councilman Ball seconded the motion, which passed as follows:

ORDINANCE 03-14

This ordinance amends Chapter 103, Rules of Public Notice.

Councilman Kirsch moved for the second reading of Ordinance 03-14, by title only. Councilman Renner seconded the motion, which passed as follows:

Ayes: Petry, Renner, Kirsch, Ball, Stonecash (5)

Nays: None (0)

Law Director Donnette Fisher read Ordinance 03-14, by title only.

Councilman Kirsch moved to adopt Ordinance 03-14. Councilman Ball seconded the motion which passed as follows:

ORDINANCE 03-15

This ordinance enacts Chapter 104, Public Records Policy.

Councilman Renner moved for the second reading of Ordinance 03-15, by title only. Councilman Kirsch seconded the motion, which passed as follows:

ORDINANCE 03-16

This ordinance amends Chapter 121, Rules of Procedure.

Councilman Kirsch moved for the second reading of Ordinance 03-16, by title only. Councilman Ball seconded the motion, which passed as follows:

ORDINANCE 03-17

This ordinance amends Section 131.01 and enacts Section 131.03, regarding administrative authority powers in an emergency.

Councilman Renner moved for the second reading of Ordinance 03-17, by title only. Councilman Kirsch seconded the motion, which passed as follows:

RESOLUTION 03-69

The three-year contract for providing fuel for City vehicles was advertised for bid and bid packets were sent to potential bidders. One bid was received from the Beoddy Oil Company. Staff recommended that this bid be awarded to that bidder. This resolution awards the contract to Beoddy Oil Company.

Councilman Kirsch moved for the adoption of Resolution 03-69. Councilman Renner seconded the motion which passed as follows:

RESOLUTION 03-70

The Eaton citizen member at-large on the Preble County Area Community Improvement Corporation Board has resigned. Mayor Stonecash wishes to be appointed to this vacated seat to fulfill the four-year term and this resolution names him as the citizen member at-large to the CIC Board.

Councilman Kirsch moved for the adoption of Resolution 03-70. Councilman Renner seconded the motion which passed as follows:

RESOLUTION 03-71

Planning Board member Gary Wagner had been appointed to the Zoning Code Review Committee. As Mr. Wagner has now been elected to Eaton City Council, a replacement for this appointment must be made. Planning Board member Harold Geeting was recommended by the Planning Board to serve on the Committee, and this resolution notes the resignation of Mr. Wagner and appoints Mr. Geeting to the Zoning Code Review Committee.

Councilman Renner moved for the adoption of Resolution 03-71. Councilman Ball seconded the motion which passed as follows:

RESOLUTION 03-72

Vice-Mayor Robert Ball has served two terms on Eaton City Council. He chose not to run in the recent election. This resolution honors Robert Ball for his service on Council.

Councilman Kirsch moved for the adoption of Resolution 03-72. Councilman Renner seconded the motion which passed as follows:

Ayes: Petry, Renner, Kirsch, Stonecash (4)

Nays: None (0)

Abstain: Ball (1)

RESOLUTION 03-73

Councilman Larry Petry has served since 1983 on Eaton City Council. He also chose not to seek re-election in the recent election. This resolution honors Lawrence Petry for his service to the City of Eaton.

Councilman Ball moved for the adoption of Resolution 03-73. Councilman Renner seconded the motion which passed as follows:

Ayes: Renner, Kirsch, Ball, Stonecash (4)

Nays: None (0)

Abstain: Petry (1)

CITY MANAGERS REPORT

a. Wayne Trace residents met with County and City staff and Council on October 27, 2003 at the County Engineers Office. This committee of residents is asking the City for certain considerations in an attempt to help alleviate some drainage problems in their area. These considerations have been reviewed by City staff and a response to the committee will be sent. Certain other considerations are being reviewed and those items will be discussed with Council in December. County Engineer Simmons has offered to use the County track hoe to clean out a portion of Rocky Run to remove the obstructions, approximate cost of $1600.

b. A board of trustees to appoint a county economic development director is being established. Council will appoint a member of City Council and a citizen at-large to this group in December.

c. There has been a modification in refuse pick-up routes with a day added for Rumpke to be in town. The reduction in tipping fees at the landfill was discussed. Representatives from Rumpke will advise of the changes to the contract regarding this reduction.

d. The Ware family has requested a hearing regarding the necessity of appropriation of their land in the vicinity of the Black Water Plant. This hearing will be in Common Pleas Court, December 3, at 2:00 p.m.

e. Annexation proceedings have begun for property on State Route 127 North in the area of the Walmart development. The Countys hearing of this was November 12, being approved 2-0. This will come before Council in January.

f. The new Municipal Court building will be completed, per contract, on December 19. The Court has advised that it will begin its move to the new facility on December 8.

g. Mr. Daily read a letter of appreciation from a citizen to the Water Department for their recent work.

OLD BUSINESS

Finish work to the upgrades at certain railroad crossings will be completed as weather allows.

NEW BUSINESS

a. Director of Service/City Engineer Doug Spitler, Public Works Superintendent Andy Eddy and Public Maintenance Supervisor Bill Smith were in attendance and discussed their proposed 2004 budgets. Final figures will be given after the first of the year.

RECOGNIZE RICK DAILY

Former Councilman and long-time Mayor Rick Daily was in attendance and wished to express best wishes to outgoing Councilmen Petry and Ball.

RECOGNIZE STAN SPENCER

Preble County Commissioner Stan Spencer also wished to extend his regards to Councilmen Petry and Ball as well.
