MINUTES OF A REGULAR MEETING OF THE EATON PLANNING, ZONING AND BUILDING APPEALS BOARD HELD IN COUNCIL CHAMBERS OF THE MUNICIPAL BUILDING AT

7:00 P.M., MONDAY, SEPTEMBER 26, 2005


A regular meeting of the Eaton Planning, Zoning and Building Appeals Board was called to order at 7:00 p.m., Monday, September 26, 2005. The Secretary called the roll and reported the following:

 

    Present:         Dave Kirsch

                            Tom Jordan

                            Nancy Clayton

                            Tom Kline

    Absent:          Brenda Conley

 

Building Inspector Bob Wehrley, Law Director Donnette Fisher and City Manager Dave Daily were also present.


MINUTES

Mr. Kirsch moved to approve minutes for the regular meeting of August 22, 2005, as submitted. Mrs. Clayton seconded the motion and passed as follows:

 

Ayes: Kirsch, Clayton, Kline (3)

Nays: None

Abstain: Jordan (1)

 

OATH

The oath was administered to the audience who wished to speak during the public hearings.

 

AB-05-16 - Dunham - Variance

The applicant is requesting a ten-foot variance from the City's R-3 rear yard setback requirements for the lot located at the southeast corner of Gilmore Avenue and East High Street. The applicant wants to build a new duplex on the vacant lot. Planning Board recommended approval of this application. Chairman Kline opened the public hearing. Dean Christman was here to represent this application. Chairman Kline closed the public hearing. Board members stated that this is a self-created hardship by building a home that is too large on the conforming lot.

 

Mr. Jordan made the motion to deny AB-05-16, because this application does not meet the applicable standards set forth in Chapter 1133.07, based on the findings of fact:

1) there are no special conditions which are peculiar to the property; and 2) the alleged problem was self-created by the applicant. Mr. Kirsch seconded the motion and passed as follows:

 

Ayes: Kirsch, Jordan, Clayton, Kline (4)

Nays: None

 

Old business

Letters have been sent to three properties on North Barron Street that have placed signs with no permits. There have been no responses to date.


New business

a. Bob has received a call from a gentleman on East Main Street who wants to manufacture his own gasohol.

 

b. Members inquired about the duplexes on West Decatur Street and if they met required setbacks. Per the site plans submitted all setbacks are in compliance.


c. Planning Board will be considering  changes to the Comprehensive Development Plan. In particular, some of the residential areas from Five Points north to the Wal Mart complex.

Mr. Jordan made the motion to adjourn the meeting. Mrs. Clayton seconded the motion and passed as follows:
