MINUTES OF A REGULAR MEETING OF THE EATON PLANNING, ZONING AND BUILDING APPEALS BOARD HELD IN COUNCIL CHAMBERS OF THE MUNICIPAL BUILDING AT
7:00 P.M., MONDAY NOVEMBER 28, 2005.
A regular meeting of the Eaton Planning, Zoning and Building Appeals Board was called to order at 7:00 p.m., Monday, November 28, 2005. The Secretary called the roll and reported the following:

Absent: Nancy Clayton
Building Inspector Bob Wehrley, Law Director Donnette Fisher, City Manager Dave Daily and Mayor Bob Stonecash were also present.
MINUTES
Mr. Jordan made the motion to accept the minutes for the regular meeting of October 24, 2005. Mr. Kirsch seconded the motion and passed as follows:

OATH
The oath was administered to the audience who wished to speak during the public hearing.
AB_05-18 - Rusk - Variance
The applicant applied for a variance from the City’s accessory use regulations to be allowed to construct a shed in the front yard, located at 121 Walnut Street. The lot is zoned ‘R-2' Residential. Because this is a through-lot, it has two front yards. Since there are two front yards, the shed is to be located at least 60' from the front yard on Walnut Street, as well as 10' from the main dwelling and 3' from the side (north) lot line in accordance with 1171.13(b) and to be allowed to sit in the required 25' front yard setback on Seven Mile Drive. Planning Board recommended approval of this variance. Mr. Rusk represented this application.
Chairman Kline opened the public hearing. Mr. Rusk stated that the proposed shed will be 8'x8'x6' and will be located at least 10' from the main dwelling. Chairman Kline closed the public hearing.
Mr. Jordan made the motion to approve AB-05-18. Based on the following findings of fact: 1) special conditions do exist as the lot has two front yards; 2) it is not a self-created problem. Mr. Kirsch seconded the motion and passed as follows:

Old business
South Barron Street property owner is waiting to hear from his attorney. The attorney has a rough draft of the agreement, which was mailed on November 15. They were to get back with us within a week of receipt of the agreement. There has been no contact to date. The owner will have two months from the day the agreement is signed to have the house sided and all new windows on the Barron Street side and all other windows repaired. The owner will then have another four months to complete the interior and have it ready for occupancy. The bank has also agreed to finance the improvements.
New business
The lot on the corner of West Monfort and Walnut Streets and been cordoned off and graded. The lot was purchased by Randy O’Dell from Maurice Duggins. Since purchased by Mr. O’Dell he has combined all lots into one and at a future date wants to construct another detached garage. However, the new UDO will not allow more than one detached garage per lot.
