MINUTES OF A REGULAR MEETING OF THE EATON PLANNING, ZONING AND BUILDING APPEALS BOARD HELD IN COUNCIL CHAMBERS OF THE MUNICIPAL BUILDING AT

7:30 P.M., MONDAY, MARCH 28, 2005



A regular meeting of the Eaton Planning, Zoning and Building Appeals Board was called to order at 7:30 p.m., Monday, March 28, 2005. The Secretary called the roll and reported the following:

 

Present:     Dave Kirsch

                    Tom Jordan

                    Brenda Conley

                    Tom Kline

                    Nancy Clayton

 

Absent:      None

 

Building Inspector Bob Wehrley, Law Director Donnette Fisher and Acting City Engineer Joe Ferriell were also present.

 

Minutes

Minutes were accepted for the meeting held January 24, 2005.

 

Mrs. Clayton made the motion to accept the minutes as written. Mr. Jordan seconded the motion and passed as follows:

 

Ayes: Kirsch, Jordan, Conley, Clayton, Kline (5)

Nays: None

 

Oath

Oath was administered to the audience who will speak during the public hearing.

 

AB-05-02 - CATO - Variance

The applicant has applied for a variance from the City's sign regulations for the new CATO's store locate in the Wal-Mart plaza. The applicant is requesting a variance of 5.35 sq. ft. on the total sign area allowed to enable them to place a "jr/ms" and a "plus" sign on either side of the CATO sign. Planning Board recommended approval of this application. Chairman Kline opened the public hearing. Mr. Edward Keys with Kap Signs was here to represent this application. CATO wanted additional text added to the sign to give definition and meaning to what CATO offers. Chairman Kline closed the public hearing. The Board felt the additional signage was necessary to provide further clarification. Law Director Fisher informed the Board that this would be a "temporary" variance because when the new UDO is in place CATO will be in compliance with the new sign regulations.

 

Mr. Kirsch made the motion to approve AB-05-02. Mr. Jordan seconded the motion and passed as follows:

 

Ayes: Kirsch, Jordan, Conley, Clayton, Kline (5)

Nays: None

 

Old business

The new UDO is almost ready to be voted on by the Planning Board for their approval before passing it on to Council for final approval.

 

The single-family home at 828 East Somers Street has been demolished.

 

The owner of the fire-damaged home at the corner of North Maple and East Somers is talking with representatives of the Methodist church and if an agreement is met the church will be turning it into a parking lot.

 

The fire-damaged home at the corner of East High and North Cherry is in process of being repaired.

 

217, 219 South Barron still has a substantial mortgage and it is hopeful that the bank holding the mortgage will come in and tear down the structure. As the lot would be worth more without the building.

 

New business

Sidewalk repairs were started last fall in front of the home at West Main and Richmond Pike and is still in a major state of disrepair.
