MINUTES OF A REGULAR MEETING OF THE EATON PLANNING, ZONING AND BUILDING APPEALS BOARD HELD IN COUNCIL CHAMBERS OF THE MUNICIPAL BUILDING AT

7:30 P.M., MONDAY, JULY 26, 2004

A regular meeting of the Eaton Planning, Zoning and Building Appeals Board was called to order at 7:30 p.m., Monday, July 26, 2004. The Secretary called the roll and reported the following:

                 Absent: Nancy Clayton

 

Building Inspector Bob Wehrley and Law Director Donnette Fisher were also present.


Minutes

Minutes were accepted for the meeting held on March 22, 2004

 

Mr. Stonecash made the motion to accept the minutes as written. Mr. Jordan seconded the motion and passed as follows:

 

Ayes: Stonecash, Jordan, Conley, Kline (4)

Nays: None

 

Oath was administered to the audience.

 

AB-04-07 - Bullen Ultrasonics - Conditional Use

The applicant applied for a conditional use permit for an addition to the existing building that exceeds 35 feet in height. Chairman Kline opened the public hearing. Lori Oldiges with Humble Construction represented Bullen Ultrasonics. Bullen wants to make a 50' x 75' addition to their existing high bay. The height of the building from finish floor elevation will be 43' plus or minus four to five inches. The proposed addition will not be higher then the existing high bay area. Chairman Kline closed the public hearing. The additional height is required to accommodate the equipment that is used in this area. A letter from the fire chief that there will be no problems in protecting the building. Building setbacks are okay as well.

 

Mr. Jordan made motion for approval of AB-04-07. Based on these findings of fact: 1) they meet the additional setbacks; and 2) letter from the fire chief that the building can be properly protected. Mr. Stonecash seconded the motion and passed as follows:

AB-04-10 - Brown - Appeal

The applicant is appealing the determination made the City's Zoning Administrator regarding the application of Section 1165.01(a) for a proposed sunroom addition located at 133 Deer Trail Drive.

 

Under Section 1165.01(a) noncomformities shall not be enlarged upon, expanded or extended, nor be used as grounds for adding other structures or uses prohibited elsewhere in the district except by appeal to the Planning, Zoning and Building Appeals Board for

approval of specific plans. Greg Neeley was here representing Mrs. Brown. The homeowner is wanting to add a 16' x 16' unconditioned sunroom. The 50' buffer requirement for the 'PD' zoning is maintained with a rear setback of 141.5'. The rear property line location was verified by Steve Pope.

 

Mr. Stonecash made the motion to grant the appeal. Mr. Jordan seconded the motion and passed as follows:

Old business

There are two cases currently tabled (Murphy Oil & Wooton) they will be placed on the August agenda.

 

The former bowling alley location has placed a sign for a business that does not exist and the property owner has been directed to remove such sign as well as the portable sign. They are to resubmit drawings for the building with a floor plan showing bowling lanes, an area for serving food and carpet sales. They will also have a liquor license. The fence has still not been lowered.

 

Stanley Samuels (200 block West Somers) has removed 4x4 posts that were propping up the front porch. He is trying to comply but doesn't seem to fully understand what is required.

 

The trees have been removed from the front of 828 East Somers Street needs to be looked at for violations and possible condemnation.

 

New business

The next zoning code review meeting is August 3 and all are encouraged to attend.

 

With unanimous approval the meeting was adjourned.
